2. What the Service does

The Service lets people publish local classified advertisements and contact one another. Unless we clearly state otherwise, we do not own, inspect, sell, buy, deliver, store or take payment for listed items. We are not a party to any transaction between a buyer and seller.

UK-only service. The Service is intended only for users and listings in the United Kingdom. Listings and wanted requests must relate to goods located in, or genuinely offered for collection or delivery within, a UK area supported by the Service. The Service is not intended to operate as an international marketplace or to facilitate cross-border listings.

Approval of an advert only means that it has passed a basic moderation review. It is not an endorsement, verification, guarantee of safety, authenticity, quality, legality or availability.

3. Accepting these Terms

By using the Service, browsing listings, submitting an advert or contacting another user, you agree to these Terms and the policies linked from them. If you do not agree, do not use the Service.

When submitting an advert, you must actively confirm acceptance of the current Terms and that you have read the Privacy Policy.

4. Age and capacity

The Service may be accessed by people under 18 and is designed to apply protective privacy and moderation measures to all users. If you are under 18, you should involve a parent or legal guardian before arranging a purchase, sale, collection, delivery or meeting with another user. You must have the legal capacity or appropriate authority required for any transaction you choose to make. Your Shop Local does not verify a user’s age or provide age verification.

5. Private and business sellers

When submitting a SELL advert you must choose whether you are acting as a Private seller or a Business seller. Choose accurately. You must not present yourself as a private seller if you are acting for purposes relating to a trade, business, craft or profession.

Business sellers are labelled on new adverts. Before submitting, a Business seller must provide a legal trader/business name, business email and a geographic business/service address; a different trading name and VAT number are requested where applicable. Business identification details may be displayed publicly with the live advert so buyers can identify the trader. For adverts and requests, a verified phone number is private by default. The person posting may actively choose to allow direct phone/text contact; only then may the verified phone number be made available to users who choose CALL or TEXT. If direct contact is not enabled, the private contact-request process is used.

Business sellers remain responsible for all information and rights required by law for the particular transaction, including accurate pricing, delivery information, cancellation/returns information where applicable, product safety, tax, advertising and consumer rights. Your Shop Local does not process the purchase or independently determine or certify a seller’s legal status. The BUSINESS SELLER label records the seller’s declaration.

6. Seller promises

By submitting an advert, you promise that:

  • you own the item or have the owner’s clear authority to sell it;
  • the item and proposed sale are lawful;
  • the advert, price, condition, defects, safety information and availability are accurate and not misleading;
  • you have disclosed material faults and any information a reasonable buyer needs;
  • you own the photographs and text or have permission to use them;
  • the item is not stolen, counterfeit, recalled, unsafe or prohibited by our policies;
  • you will not discriminate unlawfully or use abusive, deceptive or fraudulent conduct;
  • you will promptly remove or mark the item sold when it is no longer available.

7. Buyer rights and responsibilities

Seller type matters. Business-to-consumer transactions may carry statutory consumer rights that do not generally apply in the same way to private sales. See our Buyer Rights Information. Nothing in these Terms removes rights that cannot lawfully be excluded.

Buyers must assess the seller and item for themselves, inspect goods before paying where practical, ask appropriate questions, retain evidence of communications and use a safe payment and collection method. Buyers must not misuse seller contact details, harass users, make fraudulent claims or attempt prohibited transactions.

8. Listings, moderation and removal

We may review, edit, reject, suspend, hide or remove any advert or account where reasonably necessary for safety, legality, quality, security or operation of the Service. We may request evidence of ownership, identity, age, product compliance or trader status. We are not obliged to publish any advert.

We may preserve and disclose relevant information where legally required, to protect users, to investigate suspected fraud or unlawful activity, or to cooperate with regulators and law-enforcement bodies.

9. Transactions and payment

Prices and transaction terms are agreed directly between buyer and seller. Unless a future feature expressly says otherwise, the Service does not process or hold purchase money and does not provide escrow, delivery, warranties, refunds or dispute resolution.

Listings are currently free and we do not add commission to the seller’s advertised price. Any donation is voluntary and is not payment for preferential treatment, approval or buyer protection.

10. Prohibited conduct and items

You must follow the Acceptable Use Policy and Prohibited Items Policy. These policies form part of these Terms. Attempting to evade a prohibition, including by coded wording or misleading categories, is also prohibited.

11. Intellectual property and licence

You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, resize, format, display, moderate and distribute that content only as reasonably needed to operate, promote and protect the Service. This licence ends when the content is deleted, except for technical backups, legal records and content already lawfully shared.

You must not copy or commercially reuse the Service’s branding, design, code or other protected material without permission.

12. Automated and AI-assisted content

The Service may suggest titles, categories, descriptions or prices using automated tools. Suggestions may be inaccurate, incomplete or unsuitable. The seller remains responsible for checking and correcting every advert before submission. A suggested price is not a valuation, guarantee or professional advice.

13. Availability and changes

We may change, pause or discontinue any part of the Service. We do not guarantee uninterrupted, secure or error-free availability, permanent storage of adverts, or that messages will reach another user. Keep your own records.

14. Our responsibility

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to that, we are not responsible for the conduct of users, the truth of adverts, item quality or safety, failed transactions, loss caused by paying a seller, collection or delivery arrangements, or indirect or unforeseeable loss. If you use the Service for business purposes, we exclude liability for loss of profit, business, revenue, opportunity, goodwill or data to the fullest extent permitted by law.

These Terms do not remove any rights that cannot lawfully be excluded.

15. Reports, complaints and disputes

Use the process in Complaints & Reports to report an advert, illegal content, safety concern, privacy issue or complaint. Disputes about an item or payment are primarily between buyer and seller, but we may assist with information where lawful and appropriate.

16. Suspension and termination

We may restrict or end access where a user breaches these Terms, creates risk, acts unlawfully, abuses the Service or repeatedly submits unsuitable content. You may stop using the Service at any time and may request deletion of eligible personal data under the Privacy Policy.

17. Changes to these Terms

We may update these Terms to reflect legal, safety or service changes. The version and effective date will be shown at the top. Material changes should be brought to users’ attention. New submissions are governed by the version accepted at submission.

18. Law and jurisdiction

These Terms are governed by the laws of England and Wales. If you are a consumer, you retain any mandatory right to bring proceedings in the part of the United Kingdom where you live. Nothing here prevents either party seeking urgent protective relief or reporting a matter to an appropriate authority.

19. General

If part of these Terms is unenforceable, the remainder continues. A delay in enforcing a right is not a waiver. You may not transfer your rights or obligations without our consent; we may transfer operation of the Service where this does not reduce your legal rights.

Your right to bring a breach of contract claim

If we remove or restrict access to content that you have generated, uploaded or shared, or if we suspend or ban you from using the Service, in breach of these Terms, you have the right to bring a claim for breach of contract.

Direct phone and text contact

Direct CALL/TEXT contact is available only where the person posting confirms that they are 18 or over and actively allows other users to contact them by phone or text. If you enable direct contact, your verified phone number may be made available to users who choose CALL or TEXT on that post. If you call or text another user, your own phone or network may disclose your number to that person. Once users exchange contact details outside Your Shop Local, Your Shop Local cannot control how the recipient stores or uses those details, although applicable law continues to apply.
